DATES OF PROMOTION: The contest period (“Contest Period”) is from midnight EST on September 2, 2008 (“Contest Start”) to midnight ET on December 1, 2008 (“Contest End”). Administrator’s computer is the official time keeping devise for this Contest.

WHO MAY ENTER: This contest is open only to legal residents residing in the 48 contiguous United States and the District of Columbia who are 21 years of age or older at the time of entry and have valid proof of age such as driver’s license or birth certificate. Void in Alaska, Hawaii, Puerto Rico and other United States Territories and where prohibited by law.

Individuals employed by Backyard Excursions (“Sponsor”), its affiliate companies, subsidiaries, advertising and promotion agencies, or judges (collectively “Contest Parties”) at any time during the contest period, and members of their immediate family or persons living in the same household, are not eligible.

Contest entries become the property of the Sponsor and will not be returned. In case of unavailability of any prize, Sponsor reserves the right to substitute prize of equal or greater value. Participants waive the right to assert as a condition of winning any and all costs of redemption to redeem the prize and any liability, which might arise from redeeming or seeking to redeem the prize.

HOW TO ENTER: Visit the Backyard Excursions official website at www.backyardexcursions.com and click on the “Enter the Mystery Destination Contest” link on the home page. All entrants must be the authorized user of an e-mail address. You must supply an accurate, functioning e-mail address to be eligible to enter the consent and notified in the event of being selected.

It is the entrant’s responsibility to keep their e-mail addresses current. Fill out the online entry form completely. Enter your first name and last name, complete address, city, state, zip code, telephone number, and a valid e-mail address in the online entry form.

For purposes of these contest, “receipt” of an internet entry occurs when Sponsor’s servers record the entry information resulting from the entrant clicking the “Submit” button.

Sponsor is not responsible for entries not received due to difficulty accessing the Internet, service outage or delays, computer difficulties or other technological glitches. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified or any other person’s computer related to or resulting from downloading any material related to the contest, all of which may affect a person’s ability to participate in the contest.

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process. Any attempt by an entrant to deliberately damage the website or undermine the operation of the contest may be violating criminal and civil laws. If such an attempt is made, Sponsor reserves the right to seek remedies and damages, including attorney’s fees, from any such entrant, including criminal prosecution.

GENERAL RULES OF PARTICIPATION: By participating in this Contest, entrants agree to release and hold harmless Contest Parties and each of their respective parent companies, affiliates, subsidiaries, officers, directors, representatives, agents and employees, from any and all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly, 1) the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; or 2) participation in the contest or any prize related activities, including but not limited to traveling to or from any prize-related activity. Participants agree to abide by and be bound by these Official Contest Rules and the decisions of the Sponsor and waive any right to claim ambiguity in these Official Rules.

Sponsor is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of the prize.

Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prizes awarded.

ACCEPTANCE OF AWARD: By accepting the prize, the winner consents to Sponsor’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law.

PRIVACY NOTICE: Backyard Excursions collects personal data when you enter this promotion. Entering the promotion online constitutes your permission for Backyard Excursions to maintain this data. ODDS OF WINNING: The actual odds of winning will depend upon the actual number of entries received for this contest. If the winner is unreachable or does not reply to the prize notification within seven (7) days, the prize will be forfeited and awarded to another winning entrant.

RANDOM DRAWING: There will be one winner. Winner will be selected in random drawing on the date announced on www.backyardexcursions.com from all correct entries received. To be considered a correct entry, name destination name, city and state must be listed. The winner will be notified by mail and/or email. Decisions of Sponsor’s management with respect to the contest are final.

The winner must complete, sign and return an affidavit of eligibility and liability and publicity release, where permitted by law, within twenty-one (21) days of date on prize notification letter or prize will be forfeited and an alternate winner selected.

If prize or prize notification is returned as undeliverable, the prize will be forfeited and will be awarded to an alternate winner. All federal, state, and local income taxes on the prize will be the sole responsibility of the winner. No substitutions or cash redemption of prize is allowed. Prize is nontransferable. All federal, state and local laws and regulations apply.

WINNERS LIST: The name of the prize winner can be found on the website at the conclusion of each contest. CHANGES OR TERMINATION OF CONTEST: Sponsor reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of Sponsor, this Contest may be delayed, rescheduled, postponed or cancelled. Sponsor reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of Sponsor’s website or is otherwise in violation of these Official Rules. It further reserves the right to cancel, terminate or modify this Contest if it is not capable of completion as planned, should any computer virus, tampering, unauthorized intervention or other technical difficulty beyond the control of the Sponsor corrupt the administration, security or proper play of the contest and randomly award the prize among all eligible entries received prior to action taken by Sponsor.

Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the process of the entries in this Contest. Sponsor is not responsible for computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections that are human or technical in nature.

MISCELLANEOUS CONDITIONS: By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the judges, which shall be final and binding with respect to all issues relating to this Contest.

At the time you are entering a contest or contest, we may ask your permission to send you future marketing information from Backyard Excursions. If you wish to later opt-out of these emails, you can do so by checking the unsubscribe button on the email.

CHOICE OF LAW: Under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, and entrants further waive all rights to have damages multiplied or increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Michigan, without regard to Michigan conflict of law principles.
